Important – This is a Beta version of the platform

The platform Fidenly (hereinafter referred to as “the Platform”, “we”, “us” or “our”) is currently in Beta phase. This means that:

• The application is under active development and testing
• It may contain bugs, errors, interruptions or unexpected behavior
• Some features may change, be removed or added without prior notice
• We do not guarantee continuous availability, performance or complete security at this stage

By accessing or using the Platform, you accept these Terms and Conditions as written at this time. If you do not agree, you must not use the service.

1. Description of the Service

The Platform is a social network that allows registered users to:

• Create posts
• Reply to other users’ posts
• Upload images in posts and replies
• Create polls
• Publish price predictions for stocks or other financial assets

Important disclaimer regarding financial predictions

Any price predictions for stocks, cryptocurrencies or other assets posted on the Platform:

• Do NOT constitute financial advice
• Are NOT recommendations to buy, sell or hold any asset
• Have NO guaranteed accuracy
• May contain significant errors, outdated data or be completely incorrect
• Are based solely on the subjective opinion of the user who posts them
• Must NOT be used as the basis for making investment decisions

Use of any information published on this platform is at your own exclusive risk. We strongly recommend consulting official sources and qualified financial advisors before making any investment decisions.

2. Eligibility

To use the Platform you must:

• Be at least 16 years old (or the minimum digital consent age in your country)
• Not have been permanently banned from the Platform previously
• Not be using an account on behalf of another person without authorization

3. Community Rules – Prohibited Content

It is strictly prohibited to post, share or distribute:

• Sexually explicit, pornographic or suggestive content
• Violent content, gore, threats, incitement to hatred or violence
• Scams, phishing, pyramid schemes, get-rich-quick promises
• Impersonation (pretending to be another person, brand, company or institution)
• Content that infringes copyright, intellectual property or third-party image rights
• Promotion or advertising of gambling sites, casinos, or real-money betting platforms
• Promotion or links to pornographic websites
• Spam, repetitive bulk messaging or unsolicited advertising
• Intentionally false information or disinformation that may cause serious harm

4. Consequences of Violations

We reserve the right (but have no obligation) to:

• Remove any content we consider violates these Terms
• Temporarily suspend or permanently ban any account
• Restrict specific account features (reading, posting, image uploads, etc.)
• Cooperate with judicial authorities when legally required

Moderation decisions are final and may not be explained in detail.

5. Intellectual Property

• You retain copyright over the content you create (posts, images, polls, predictions).
• By posting, you grant the Platform a worldwide, non-exclusive, royalty-free license to display, reproduce, distribute, modify (only for technical formatting purposes) and promote that content within the Platform and in related communications.
• The Platform’s trademarks, logos and design are the exclusive property of its creators.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Platform is provided “as is” and “as available”
• We do not guarantee it will be error-free, virus-free, uninterrupted or free of data loss
• We are not responsible for economic losses, lost investment opportunities, emotional damage or any other harm arising from the use (or inability to use) the Platform
• We are not liable for user-generated content or interactions between users

7. Indemnification

You agree to defend, indemnify and hold us harmless from any claim, loss, liability, expense (including reasonable legal fees) arising from:

• Content you post
• Your breach of these Terms
• Your violation of third-party rights

8. Changes to the Terms

We may modify these Terms at any time. We will notify you of significant changes through a notice on the platform or by email. Continued use after changes constitutes acceptance of the updated version.

9. Termination

You may stop using the Platform at any time by deleting your account (if the feature is available in Beta).
We may terminate your access at any time, with or without cause, with or without prior notice.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Argentina.
Any dispute shall be submitted to the competent courts of Autonomous City of Buenos Aires.
